Terms and Conditions

1. Rental Requirements and Documents:

The minimum age to rent is 21 years old as of the vehicle delivery date. Renters between the ages of 18 and 20 may rent by adding the young driver surcharge.

To authorize a driver, a valid driver's license and national ID or passport are required, valid until the end of the contract. If the driver's license is not written in the Latin alphabet, an international driver's license will be required.

In the case of adding additional drivers, they must present the same documentation as the primary driver.

Under no circumstances may drivers operate the vehicle without carrying the documents and licenses required by the authorities.

 

2. Guarantee and Rental Payments

2.1. Rental Guarantee

To ensure the faithful and timely fulfillment of all obligations arising from the rental contract, Hertz Chile reserves the right to request and establish the forms of guarantee it deems appropriate. The amount and type of guarantee will depend on the vehicle category, insurance, additional contracted services, and other factors determined by the company.

The renter expressly authorizes Hertz Chile to enforce the guarantee, in whole or in part and without further procedures, in order to apply it toward the payment of any amounts owed under the vehicle rental contract. This includes, but is not limited to, deductibles, fines, damages to the vehicle, additional rental days, and any other applicable charges.

In the event that the guarantee is insufficient to cover the amounts owed, the renter shall be responsible for the outstanding balance, and Hertz Chile may pursue collection through either extrajudicial or judicial means. The costs of such collection shall be borne by the debtor.

The refund of the guarantee will be processed at the end of the contract, subject to inspection and proper return of the vehicle, provided it is in the same condition as when delivered and no debts remain outstanding. The refund period will depend on the type of guarantee established and the processing times of the financial institutions involved.

If, at the time of return, the vehicle presents dirt, mud, or any other condition that prevents proper inspection, the refund of the guarantee will be suspended until the vehicle can be cleaned and duly inspected.


2.2. Payment Methods

Hertz Chile accepts all legally valid means of payment in the national territory for the rental and associated services, including, but not limited to, credit cards, debit cards, electronic transfers, and cash, subject to the particular conditions of each branch.

3. Rental Reservation:

Lucky Team Spa (hereinafter referred to as “Hertz Chile”) does not confirm the specific model, color, fuel type, or make of the vehicle, only the category.

Hertz Chile will hold the reserved vehicle for a maximum period of 2 hours after the time indicated in the reservation or until the closing time of the corresponding Hertz Chile branch, whichever comes first. Otherwise, it will be understood that the customer has withdrawn from the vehicle rental (No Show), and Hertz Chile may dispose of the vehicle at its discretion to be rented to other people.

Refunds or returns for unused days or due to non-compliance with rental requirements will incur a charge of 10% of the total reservation value.

 

4. The Base Rate Includes:

The rate includes T/km (time and mileage) + Basic Coverages (CDW and DAT). The CDW coverage includes the payment of a deductible by the renter. The coverages are detailed in section No. 7.

Roadside Assistance in case of a mechanical failure not attributable to negligence on the part of the renter, within the national territory.

Replacement car, this is subject to availability, schedule, and branch. To be effective, it must be picked up by the customer at the nearest branch; delivery is not applicable.

One rental day for the vehicle is considered 24 hours from the start time of the contract.

Hertz Chile allows a maximum delay of 1 hour for the vehicle's return without an additional charge. Any delivery with a longer delay will incur an extra charge.

 

5. Additional Charges for Vehicle Rentals

5.1 Delays in Return

The grace period is 2 hours; after this time, a charge for extra hours or an additional day will be applied as appropriate.

5.2 Fuel

Fuel is not included in the rate. The vehicle is delivered with a full tank and must be returned the same way to avoid refueling charges.

5.3 Rental Extensions

To extend your rental, you must contact the office where you picked up the unit or the reservations center. A rental extension may incur additional charges. Subject to availability.

Any reservation extension must be paid for within a maximum of 24 hours from the request. Otherwise, the unit must be returned promptly.


6. Prepaid Reservation Return Conditions

This section applies only to prepaid reservations made online directly on the Hertz Chile website. To cancel and request a refund for prepaid reservations, you must contact the Reservations Center at 600 300 30 40, WhatsApp +569 7440 38 22, or by email at customer@hertz.cl. If Hertz Chile does not receive this request through these channels with the required information, the requested process cannot be completed.

       
  • Cancellations made more than 30 days before the pickup date will incur a 0% charge of the total reservation value from your refund.
  •    
  • Cancellations made more than 48 hours before the pickup date will incur a 20% charge of the total reservation value from your refund.
  •    
  • Cancellations made less than 48 hours before the pickup date will incur a 40% charge of the total reservation value from your refund.
  •    
  • No refunds will be given for prepaid "No Show" reservations (failure to give notice or show up for your reservation), or for reservations and/or contracts for unused prepaid rental days.
  •    
  • In cases where the reservation includes a border crossing permit, this value will not be included in the total refund.

In cases where a refund is applicable, as stated above, the amount will be refunded to the same credit or debit card of the cardholder who made the payment. This will be effective within 15 business days from the date the request was sent to Hertz Chile.

The final date of the refund to the bank account will depend on the issuing bank.

 

7. Coverages:

All coverages mentioned below will only apply within Chilean territory and will not be applicable in cases of negligence, fault, or willful misconduct on the part of the renter and/or vehicle driver. Additionally, coverages are not applicable in cases of faults and/or violations of the current traffic regulations in the Republic of Chile.

The base rental rate includes Basic Coverages, as indicated on the website, https://www.hertz.cl/coberturas-y-garantias-para-el-auto

Our coverages are Base, Plus, and Smart Cover.

Base

       
  • Your minimum guarantee will be maintained at $600,000 Chilean pesos.
  •    
  •         Civil Liability = Mandatory civil liability coverage for third parties, with a cap of 1,000 UF.    
  •    
  • Damage - Coverage for damages to the rented vehicle, with a deductible of 30 UF + VAT.
  •    
  • Collision - Coverage for collision under the responsibility of the driver designated in the contract, with a deductible of 30 UF + VAT.
  •    
  • Rollover - Coverage in case of rollover, under the responsibility of the driver designated in the contract, with a deductible of 50 UF + VAT.
  •    
  • Theft - Coverage in case of theft, under the responsibility of the driver designated in the contract, with a deductible of 50 UF + VAT.


Plus Cover

       
  • Maintains a minimum guarantee of $600,000 Chilean pesos.
  •    
  • Civil Liability - Mandatory civil liability coverage for third parties, with a cap of 3,500 UF.
  •    
  • Damage - Coverage for damages to the rented vehicle, with a deductible of 10 UF + VAT.
  •    
  • Collision - Coverage for collision under the responsibility of the driver designated in the contract, with a deductible of 15 UF + VAT.
  •    
  • Rollover - Coverage in case of rollover, under the responsibility of the driver designated in the contract, with a deductible of 20 UF + VAT.
  •    
  • Theft - Coverage in case of theft, under the responsibility of the driver designated in the contract, with a deductible of 30 UF + VAT.
  •    
  • Windshield Breakage - Deductible of 0 UF.

 

Smart Cover:

       
  • You will only pay 50% of the guarantee in Chilean pesos.
  •    
  • Civil Liability - Mandatory civil liability coverage for third parties, with a cap of 7,500 UF.
  •    
  • Damage - Coverage for damages to the rented vehicle, with a deductible of 0 UF.
  •    
  • Collision - Coverage for collision under the responsibility of the driver designated in the contract, with a deductible of 0 UF.
  •    
  • Rollover - Coverage in case of rollover, under the responsibility of the driver designated in the contract, with a deductible of 10 UF + VAT.
  •    
  • Theft - Coverage in case of theft, under the responsibility of the driver designated in the contract, with a deductible of 30 UF + VAT.
  •    
  • Windshield, Glass, and Lock Breakage: Deductible of 0 UF.

 

Important Information:

       
  • Requires a police report and declaration at a Hertz branch.
  •    
  • Does not include missing parts, or damages due to natural causes and/or catastrophes.
  •    
  • Does not include tires or rims.

 

8. Additional Equipment:

Additional services or equipment are subject to availability and have an associated charge.

Hertz Chile is not responsible for additional services or equipment that have not been confirmed in the reservation.

 

9. Accident

In the event of an accident, theft, or robbery of the vehicle, a sworn statement of the accident and/or a police report must be filed with the Carabineros de Chile, as appropriate. If there are no injured third parties, the renter must complete a simple sworn statement at the nearest Hertz Chile office detailing the circumstances of the accident within a maximum of 24 hours from when the events occurred.

If there are injured third parties, it is mandatory to immediately go to the nearest Carabineros de Chile police station to file a report and give immediate notice to Hertz Chile. If the events occur outside business hours, you must give immediate notice by calling our roadside assistance phone number indicated on our website.

For the declaration to Hertz Chile, all information regarding the events must be provided, including the name, national ID number (Rut), and phone number of any third party involved, as well as the license plate, make, model, and insurance company of the vehicles involved. Photographs of the location and vehicles, showing the damage caused, will also be requested.

If the renter fails to follow the established procedure, the full cost of the damages, both to the vehicle and to third parties, will be charged to the credit card specified in the rental agreement. Similarly, depending on the coverages contracted, charges for accidents will be applied.

 

10. Loss or Misplacement

10.1 Vehicle Documentation
In the event of loss or misplacement of the vehicle’s documents (Registration Certificate, Circulation Permit, Mandatory Insurance [SOAP], Homologation Certificate, or Technical Inspection), an additional charge of 2 UF + VAT will apply.

In the case of loss of the license plate, a charge of 3 UF + VAT will be applied to cover the administrative procedures related to this matter.

10.2 Keys
Loss of key or vehicle locked with the key inside: The renter must contact the branch where the vehicle was rented to request a duplicate key. This duplicate must be collected at the same branch where the rental was made; the service does not include “Delivery.”

If a duplicate key is requested outside branch service hours, the renter must call the emergency number to request a tow truck (in the event that the vehicle needs to be removed from its location), and then contact the branch the following business day during service hours.


11. Fuel:

Vehicles are delivered with a full tank of fuel and must be returned in the same condition. The fuel tank level is declared on the Vehicle Acceptance Report.

In cases where a different fuel from the one required by the vehicle is used (diesel instead of gasoline or vice versa), all costs associated with cleaning the tank, engine, or other damages caused to make the vehicle operational will be the responsibility and charge of the renter. Similarly, the corresponding charge for the fuel service mentioned above will be applied.

 

12. Airport Fee:

A surcharge of 10% of the total rental price will be applied when the vehicle is picked up from an airport.

 

13. Televía (TAG) Charge:

The rental rate indicated in your quote, reservation, and/or contract does not include the payment for the TAG service (Televía service for traveling on toll roads). This charge is made at the end of the rental contract based on the consumption shown on the contract during the rental period, to which a 10% administrative fee will be added.

All Hertz Chile units are enabled to travel on toll roads and tolls that are equipped with the TAG system.

If the customer makes a manual payment on a toll road, they must prove this with the payment receipt(s) for the respective discount to be applied.

 

14. International Permit (Travel to Argentina):

The permit to travel to Argentina with a Hertz Chile vehicle must be requested a minimum of 24 business hours before the rental start date. To do so, all information required by Hertz Chile must be provided to obtain the permit. Once the permit is approved by Hertz Chile, the renter will be given the required documentation for the trip (notarized permit, mandatory insurance, and Customs form for departure).

Argentine nationals may not request this permit unless they prove permanent residency in Chile for more than one year with a certificate issued by the respective consulate.

The permit has a cost, which must be prepaid via credit card and/or electronic transfer to process the request. There will be no refund if the renter does not proceed with the vehicle rental or does not travel to Argentina.

If the permit is requested for a trip to Argentina, it will have a cost of $250,000 Chilean pesos plus VAT. The requested permit includes the insurance required by Mercosur, which exclusively covers damages caused to third parties.

In the event of a delay in the vehicle's return, the renter remains responsible for it, and the contract will remain in effect until the unit is received at any Hertz office in Chile. If it is necessary to incur costs for transfers, towing services, customs fines, additional rental days, etc., these will be the responsibility of the renter.


15. Roadside Assistance Service (Towing)

If roadside assistance (towing) is required for reasons attributable to the operation or misuse of the vehicle (battery charging, door opening, tire changes, etc.), this will be at the renter's expense.

If the tow truck is needed due to a mechanical failure, accident, or collision not attributable to misuse, the service will be at the expense of the rental company.

To request this service, the renter must call the 24-hour roadside assistance number indicated on the vehicle's keychain and in the rental agreement.

 

16. Vehicle Delivery:

The renter declares to receive the vehicle in perfect mechanical and body condition, with its accessories and an enabled TAG or Televía electronic device, with a license plate, circulation permit, mandatory insurance, and technical inspection, all current and as per the Vehicle Delivery/Reception Report. In addition, the renter declares to have verified that the rented vehicle has the necessary accessories according to current legal traffic regulations, as well as those detailed in the Vehicle Delivery/Reception Report that the renter has signed as compliant upon receiving the vehicle.

If an additional accessory like a child seat is required, it cannot be installed by Hertz Chile employees. The parents or guardians of the child must personally perform the installation, thereby ensuring the child's safety.

Force Majeure: In the event that the circulation of the rented vehicle is prohibited by a determination of a sub-secretariat, intendant, Ministry of Transportation, the government, or another competent authority or entity, which implies restrictions for certain license plates, Hertz Chile is not responsible for unused days, nor is it obligated to substitute the vehicle involved. The renter will be responsible for any extra costs that such a prohibition or restriction may cause (costs for transportation, parking, etc.).

 

17. Vehicle Return:

The renter must return the vehicle in the same condition in which it was delivered, according to what is indicated on the Delivery/Reception form, which is signed by the renter at the time of vehicle reception.

If the renter returns the vehicle outside of Hertz Chile's office hours or without the vehicle being received by a Hertz Chile employee, by using the key drop box, the vehicle inspection will be carried out later and the Reception Report will be sent to the renter by email. Since the vehicle was not received by Hertz Chile personnel, the renter should photograph the dashboard (especially the fuel level) and the exterior of the vehicle from all sides.

Any differences between delivery and return that are not covered by the contracted coverages will be charged to the renter.

It is the renter's responsibility to remove all personal items from the vehicle, and Hertz Chile is not responsible for their loss or misplacement.

In any case, if the vehicle is not returned in a timely manner, whatever the situation or circumstance, the renter will be prohibited from using the vehicle, it being understood that from that moment on it is being used without the knowledge or authorization of its owner. The renter will be exclusively responsible for any events or actions that occur, without prejudice to the rental company's right to report the misappropriation or theft of the vehicle, or to exercise any legal action that is appropriate.

 

18. Fines and Damages:

The renter is responsible for all penalties, fines, or sanctions that originate from or result from violations of traffic laws or other laws, regulations, ordinances, instructions from Carabineros de Chile, or other applicable regulations during the rental period. In this way, the renter irrevocably authorizes Hertz Chile to charge all fines attributable to the renter to the credit card registered as a guarantee at the beginning of the rental contract, even if such fines are known to the rental company after the date of the rented vehicle's return.

Likewise, the renter is responsible for all damages and losses caused to the vehicle or to third parties' persons or property due to negligent use of the vehicle or use contrary to the manufacturer's recommendations. Consequently, the renter irrevocably authorizes Hertz Chile to charge all amounts for damages or losses attributable to the renter to the credit card registered as a guarantee at the beginning of the rental contract, provided they are duly accredited.

 

19. Drop-off Charges Table:

An additional charge will be applied when the rented vehicle is returned in a different city from the one it was picked up in. Vehicles can only be returned to one of the offices listed on the Hertz Chile website under the Rent a Car section.

The charge for dropping off at a different location will be calculated based on the distance between the pickup and drop-off points, as indicated in the following table:

20. Additional Driver:

It is necessary to register additional drivers, presenting a valid driver's license and national ID, before the rental is made and to list them in the rental contract.

In the event of an accident where the driver of the rented vehicle at that time is not one of the drivers declared in the rental contract, the coverages will become void, and the renter will be fully responsible for the loss of the vehicle and all damages and/or losses caused to the vehicle and/or third parties.

The above will apply in all cases where an accident or loss of the vehicle occurs while it is in the possession of a third party not authorized by the rental company.

 

21. Value Added Tax in Chile (VAT):

The Value Added Tax (VAT) is applied to the total of the contracted services and is currently 19%.

 

22. Return of Dirty Vehicles:

If the vehicle is returned with strong odors, cigarette smell, excess mud, animal hair, spilled food or liquids, solids, and/or trash that dirty or stain the upholstery and/or floors, a surcharge for cleaning will be applied. Similarly, the rental company may charge for an additional day of rental for the required cleaning work, if circumstances warrant it.

 

23. Text Messages (SMS) and Whatsapp (Wsp):

By making a reservation, the renter is expressly agreeing to be sent informational text messages (SMS) and/or Whatsapp (Wsp) as a normal part of the reservation and vehicle rental process. Each renter may request not to receive informational text messages (SMS) and/or Whatsapp (Wsp) by sending an email to reservas@hertz.cl indicating that they do not wish to continue receiving such messages, along with the cell phone number on which they receive the messages.

 

24. Identity Verification:

At the time of contracting vehicle rental services, Hertz Chile will verify the identity of the renter using the mechanisms available to it, in compliance with the Privacy and Confidentiality of Information Policy, and with applicable legal regulations, namely, Law No. 19.496 on the Protection of Consumer Rights, Law No. 19.628 on the Protection of Private Life, and Law No. 20.575 which establishes the Principle of Purpose in the Processing of Personal Data.

The terms indicated are of a general nature, and the rental company reserves the right to establish particular and/or special conditions in the rental contract.

 

25. Prohibitions:

The renter is expressly prohibited from doing the following:

Allowing the vehicle to be driven by any person not declared in the rental contract.

Using it for paid transportation or as a public or private passenger transport vehicle.

Subleasing the rented vehicle or assigning its use to third parties not declared in the rental contract. In this case, the renter will be responsible for the actions of their dependents as their own and under any circumstances where the vehicle suffers an accident or causes damage to the rental company or third parties while being driven by unauthorized persons in the manner described above.

Performing repairs, alterations, and/or modifications of any kind to the vehicle without the consent of the rental company.

Using it for transporting cargo that exceeds the maximum capacity defined by the manufacturer. Likewise, it cannot be used for illicit activities, to tow or push another vehicle, or to tow trailers.

Driving the rented vehicle while under the influence of drugs, narcotics, alcohol, and/or in a state of drunkenness; likewise, the driver of the rented vehicle is prohibited from refusing to take a breathalyzer or other corresponding test when required by the competent authority.

Driving the contracted vehicle without a valid driver's license for the type of vehicle rented. Furthermore, the driver must keep the documentation required by traffic law for circulation in the vehicle, which is provided by Hertz Chile at the time of vehicle delivery, and which will be noted in the Delivery Report.

Leaving national territory with the vehicle, unless a prior international permit has been obtained from Hertz Chile.

Manipulating, removing, or dismantling the Televía (TAG) device, or any other part or accessory of the vehicle.

Driving through zones or places that are not roads authorized by the competent authorities. In the case of two-wheel-drive vehicles, driving on unpaved and/or unpaved roads is prohibited.

Abandoning the vehicle in case of failure, accident, or any other cause. In such a case, the renter must call the roadside assistance service and coordinate the towing of the vehicle, and is obligated to wait for the vehicle to be retrieved according to the instructions given by this service.

Driving the vehicle without paying attention to traffic conditions, in a negligent manner, or contrary to the use recommended by the manufacturer or to current legal and traffic regulations.

 

26. Time Off (After-Hours Delivery):

This term is used for deliveries scheduled outside of Hertz Chile's defined business hours at its airports in Chile.

Hertz's defined business hours for its service counters at airports are Monday to Sunday from 7:00 a.m. to 10:00 p.m. If the vehicle delivery is outside these hours, Hertz Chile will charge a service called "Time Off," or after-hours delivery, and the amount to be charged will be $30,000 + VAT.

In the event that a flight is delayed and the renter arrives after the business hours defined and informed by Hertz Chile, the extra charge indicated in this section will be applied.

28. Miscellaneous:

The terms stated are general in nature, and the rental company reserves the right to establish particular and/or special conditions in the rental contract. These Terms and Conditions will be applied and understood to be incorporated into each of the contracts that Hertz Chile enters into. The use of this website, the application of these Terms and Conditions, the actions performed, and the contracts entered into through this website are subject to and governed by the laws of the Republic of Chile.

 

29. Acceptance:

By the sole act of renting a vehicle with Hertz Chile, the renter fully accepts these Terms and Conditions and is obligated to respect them in their entirety.
